Who Can Assign a Trademark in India?
- Registered Proprietor: The registered owner of a trademark is legally entitled to transfer ownership.
- Unregistered Mark Owner: The lawful owner of an unregistered trademark may also assign rights subject to enforceability conditions.
- Joint Proprietor: A joint proprietor can assign their share in accordance with the terms agreed between co-owners.
- Legal Successor: A legal successor such as an heir, executor, or administrator may assign a trademark upon valid succession.
Types of Trademark Assignment
Complete Assignment
All ownership rights in the trademark are transferred to the assignee for all goods or services.
Partial Assignment
