Taxcom Technologies LLP

This document is an electronic record in terms of the Information Technology Act, 2000 and the rules thereunder, as applicable, and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and Rule 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, framed under the Information Technology Act, 2000 (as amended from time to time).

The online platform at www.taxcom.co.in ("Website") is owned and operated by TAXCOM TECHNOLOGIES LLP, a Limited Liability Partnership incorporated under the Limited Liability Partnership Act, 2008, with its registered office at NH-117, 2nd Floor, Amtala Baazer, Kolkata, South 24 Parganas, West Bengal – 743503 (hereinafter referred to as "Taxcom Technologies", "We", "Our", or "Us"). The Website, its sub-domains, and all other channels maintained by Taxcom Technologies to enable the Services shall collectively be referred to as the "Platform". 3. Service Timelines and Completion

All timelines communicated for the completion of services are estimates and shall not be construed as a binding contractual commitment by Taxcom Technologies LLP. The timely completion of services is often dependent upon factors beyond our direct control, including but not limited to:

  • Processing times at government departments and regulatory authorities
  • Response times from third-party vendors, Chartered Accountants, Company Secretaries, or other professionals
  • Payment gateway processing and banking procedures
  • Accuracy and completeness of documents and information submitted by the client

Taxcom Technologies shall not be held liable for any delays arising from such external dependencies. We will, however, make all reasonable efforts to keep clients informed of progress and any anticipated delays.

4. Pricing and Payment Terms

Taxcom Technologies has implemented a transparent pricing policy for its services. The prices displayed on our Website represent the starting fee and may vary depending on factors such as the client's location, the nature and complexity of the service, applicable government fees, and the volume of work involved.

Please note the following with respect to pricing:

  • We reserve the right to revise the prices listed on our Website at any time. However, any such revision shall not affect services for which a contract has already been initiated and fees collected.
  • The quoted price does not include any increase in government fees, stamp duty, or statutory charges that may be levied after the initiation of the service.
  • If documents submitted by the client are rejected by a government authority due to errors or omissions on the part of the client, any additional fees incurred for resubmission shall be borne by the client.
  • If a price displayed on our Website is found to be inaccurate or outdated, we will communicate the correct price to the client before proceeding with the service.
  • We are not liable for any additional costs incurred by the client outside the scope of the agreed service.

5. Limitation of Liability

To the fullest extent permitted by applicable law, Taxcom Technologies LLP shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or in connection with your use of, or inability to use, our Platform or Services. This includes, but is not limited to, loss of data, loss of profits, business interruption, or any other pecuniary or non-pecuniary loss, even if we have been advised of the possibility of such damages.

In any event, the aggregate liability of Taxcom Technologies to you for any claim arising out of or related to these Terms shall not exceed the total amount paid by you to Taxcom Technologies for the specific service giving rise to the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Taxcom Technologies LLP, its partners, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Platform or Services
  • Your violation of these Terms of Service
  • Your violation of any applicable law or the rights of any third party
  • Any content submitted or transmitted by you through our Platform

We reserve the right to assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defences.

7. Intellectual Property and Copyright

All content and materials available on www.taxcom.co.in — including but not limited to text, graphics, logos, icons, images, audio clips, and software — are the exclusive intellectual property of Taxcom Technologies LLP and are protected under applicable Indian copyright, trademark, and intellectual property laws.

Unauthorised use, reproduction, distribution, modification, or transmission of any content from this Website, in whole or in part, is strictly prohibited without the prior written consent of Taxcom Technologies LLP.

10. Termination of Access

We reserve the right, at our sole discretion, to suspend or terminate your access to all or any part of our Platform and Services, with or without prior notice, for any reason, including but not limited to a breach of these Terms of Service.

Any suspected illegal, fraudulent, or abusive activity may result in immediate termination of your account and may be reported to the relevant law enforcement authorities. Upon termination, your right to use our Platform will immediately cease, and we reserve the right to delete any account data or information associated with your account.

11. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, or validity thereof shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal, India. By using our Platform, you consent to the personal jurisdiction of such courts and waive any objections on grounds of venue or inconvenient forum.

12. Amendments to These Terms

Taxcom Technologies reserves the right to update, modify, or replace these Terms of Service at any time. Changes will be effective immediately upon posting to our Website. We will endeavour to notify registered users of material changes via email or a prominent notice on our Platform.
