What is Design Registration?
Design registration is the legal process of protecting the unique visual appearance of a product, such as its shape, pattern, or ornamentation. In India, registering a design gives the creator the exclusive right to use it on products, manufacture and sell items featuring the design, and stop others from copying or imitating it without permission.
Governed by the Designs Act 2000, this process ensures that a design is truly original, aesthetically unique, and hasn't been published before. Unlike patents, which protect how something works, design registration focuses purely on how it looks—its shape, pattern, or overall appearance.
Essential Requirements for Design Registration
Novelty & Originality
The design must be new and not previously published, used, or sold publicly in India or elsewhere before your application date.
Visual Appeal (Aesthetic)
It must be primarily ornamental and visually attractive, rather than purely functional. Designs driven solely by an article's function are generally not registrable.
Industrial Applicability
The design must be suitable for application to an article through industrial processes, allowing for its reproduction on manufactured goods.
Non-Prohibited
The design should not violate public order or morality, threaten national security, or be a mere mechanical contrivance or copyrighted work.
Types of Designs Available for Registration
Surface Designs
Patterns, ornaments, or decorative elements applied to the surface of products.
Shape Designs
Three-dimensional forms or contours that give a unique appearance to products.
Characteristics of Design Registration
Validity & Renewal
Design protection lasts for 10 years after registration, and an additional 5 years can be gained on renewal.
Scope of Protection
Protection covers the visual appearance (shape, pattern, ornamentation) of the product, not its functional aspects.
Territoriality
Protection is domestic to India, though international protection can be pursued via the Hague Agreement.
Transferability
Design rights are transferable or licensable through written agreements, which must be recorded with the Design Office.
Benefits of Design Registration
Legal Protection
Grants the owner the sole right to use the design on a product throughout India, preventing others from selling or importing it.
Commercial Value
A registered design is a business asset that can be sold, licensed for royalties, or used as collateral.
Marketplace Advantage
Establishes a unique visual identity that distinguishes a product from competitors, building brand reputation and customer loyalty.
Investor Confidence
A protected design portfolio demonstrates strong IP management, making the business more attractive to investors and partners.
